Agency booking terms

The following Agency Booking Conditions together with our Privacy Policy and, where your enquiry is made via the website, our website terms and conditions of use, together with the general information contained on our website and any other information we brought to your attention on the telephone before we confirmed your booking with Kaluma Travel Limited govern your booking made Watergate Bay Hotel Limited, a company registered in England and Wales with company number: 03709185 and registered office at Watergate Bay Hotel, Watergate Bay, Newquay, Cornwall, TR8 4AA.

Please Note: We act only as an agent in respect of all bookings we take and/or make on your behalf with Kaluma Travel Limited, a company registered in England and Wales with company number: 04783110 and registered office at Cedar Court, College Street, Petersfield, England, GU31 4AE (Kaluma Ski).

We accept no liability in relation to any contract you enter into for your stay, or other any other services you purchase in respect of your stay with Kaluma Ski or for the acts or omissions of any supplier or third party connected with any such arrangements. For all bookings, your contract will be with Kaluma Ski.

These Agency Booking Conditions set out our respective rights and obligations so please read them carefully. By asking us to confirm your booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that he/she/they:

  • is / are over 18 and authorised to make the booking on behalf of all persons named on the booking and by the parent / guardian of any children under 18 years of age named on the booking;
  • has read these Agency Booking Conditions and agree to be bound by them;
  • consents to our use of personal data in accordance with our Privacy Policyand is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements);
  • accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

In these Agency Booking Conditions “you” and “your” means all persons included in the booking (including anyone who is added or substituted at a later date).

“We”, “us” and “our” means Watergate Bay Hotel Limited.

Making your booking

All enquiries are made through our website and all bookings are made via telephone. Secure payment is taken at the time of booking.

When making your booking we will arrange for you to enter into a contract with Kaluma Ski as agent. We accept no responsibility for the acts or omissions of Kaluma Ski or for the services provided by them.

Your booking via us is subject to these Agency Booking Conditions and Kaluma Ski’s booking conditions and we advise you to read both carefully prior to booking. Kaluma Ski’s booking conditions may limit and/or exclude their liability to you.

We are entitled, on behalf of Kaluma Ski, to refuse any booking placed by you.

Prices & Payment

Accommodation prices are quoted in pound sterling  (exchange based on that day’s exchange rate). Please note, changes and errors occasionally occur. You must check the price of your chosen accommodation at the time of booking. We reserve the right to increase or decrease prices of unsold accommodation to correct errors at any time.

A deposit equivalent to 50% of the booking fee is required at the time of booking. Attempted bookings made without payment of the deposit, or where payment fails, will be cancelled and you will not receive a confirmation booking email.

The balance of the booking cost must be received by us in full no later than 2 January 2025. This date will be shown in your booking confirmation. Balance payments must be paid by credit card. If payment is not received in full and on time, the booking will be cancelled and Kaluma Ski will be entitled to retain your deposit. If we do not cancel your booking straight away because you have promised to make payment, you must pay any cancellation charges which become payable in accordance with Kaluma Ski’s booking conditions

Credit Card payments are processed by us, acting as booking agent on behalf of Kaluma Ski.

Except where Kaluma Ski tells you or their booking conditions state otherwise, all monies you pay to us in respect of the booking will be held by us as agent on behalf of Kaluma Ski and forwarded on to Kaluma Ski in accordance with our agreement with Kaluma Ski.

Damage Deposit

We may require a damage deposit as a precaution against any damage sustained to the accommodation during your stay. When you book through us, you accept responsibility for any damage or loss caused by you or any member of your party.

Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made as soon as possible if not deducted from the damage deposit or the deposit is insufficient to cover the damage or loss. If the actual cost of the loss or damage exceeds the damage deposit paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against Kaluma Ski and all costs incurred by it (including Kaluma Ski and the other party’s full legal costs) as a result of your actions.

Confirmation

Subject to the availability and receipt of payment, you will receive an email to the email address given at the time of booking, confirming your payment.

Your booking is confirmed and a contract between you and Kaluma Ski will exist when we send you confirmation of your booking.

The booking information that you provide to us will be passed on to Kaluma Ski, therefore please check that all names, dates and timings are correct on the booking confirmation, and any other document and advise us of any errors immediately. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.

If you do not receive a booking confirmation within 24 hours of payment, please contact us immediately via .

The booking information that you provide to us will be passed on only to Kaluma Ski [or other third parties necessary for the provision of the services].

You will need to take your booking confirmation with you as you may need to present this upon arrival to gain access.

Special requests

If you have any special requests (for example dietary requirements), please let us know at the time of the booking. We will pass on all such requests to Kaluma Ski, but we can’t guarantee that they will be met and we will have no liability to you if they are not. The fact that a special request has been noted on your confirmation email or any other documentation or that it has been passed on to Kaluma Ski is not confirmation that the request will be met.

Medical conditions

If you or any member of your party has any medical condition or disability which may affect your stay, please provide us with full details before we confirm your booking and we will pass them on to Kaluma Ski.

Please note that the accommodation may not be suitable for people with certain disabilities, medical conditions or significantly reduced mobility. On request, We can advise you as to whether Your proposed holiday arrangements are generally suitable. Should You or any member of Your party suffer from any medical condition, disability or significant reduction in mobility which may affect Your holiday (including any which affect the booking process) or have any special requirements as a result, please tell Us before you confirm your booking so that We can assist You in considering the suitability of the arrangements and/or making the booking. You must give Us full details in writing at the time of booking and whenever any material change in Your or any member of Your party’s condition, disability or mobility occurs.

Acting reasonably, if Kaluma Ski is unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking on Kaluma Ski’s behalf or, if you did not give us full details at the time of booking, we will inform Kaluma Ski who may cancel the booking and may impose applicable cancellation charges, when we become aware of these details.


Travel requirements & Insurance

Please carefully review the travel requirements (passport, visa and health requirements) as set out in Kaluma Ski’s  booking conditions. You are responsible for ensuring that you and each of your party:

  • carry a valid passport and/or visa if required
  • comply with any entry requirements
  • find out if you need a visa to pass through a country that isn’t your final destination
  • check with the relevant embassy in advance to see if there’s been any change in passport, visa or entry requirements
  • review any warnings or advice from your country of residence/origin before you go to/through a country or region.

You are required you take out a policy of insurance at the point of booking  in order to cover you and each member of your party against the cost of cancellation by you, the cost of assistance in the event of accident or illness,  loss of baggage and money and other expenses. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs, including all winter sports / activities which you may wish to take part in. Please check Kaluma Ski’s booking conditions for further information as a copy of such travel insurance will be required.

Personal data

The booking information that you provide to us will be passed on only to Kaluma Ski or other third parties as necessary for your stay and your related arrangements. Please see our Privacy Policy for more information on your rights and how we process personal data.

Your personal information may be provided to public authorities as required by law.

Any special category (sensitive) information that you give to us such as details of any disabilities, dietary and / or religious requirements is provided with your explicit consent. In making your booking, you also consent to this information being passed on to the relevant third parties in relation to your booking.

Certain information may also be passed on to security or credit checking companies. If we cannot pass this information to Kaluma Ski we may be unable to provide your booking.

Accuracy

We endeavour to ensure that all the information and prices both on our website and in any advertising material that we publish are accurate, however, occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating  to the stay that you wish to book before you make your booking.

All descriptions and content on our website or otherwise issued by us is done so on behalf of Kaluma Ski and are intended to present an overview of the services provided by Kaluma Ski. All services shown are subject to availability. If you require any further details, please contact us.

Behaviour

You are expected to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of others. No pets are allowed in the property without the prior written agreement of Kaluma Ski. Smoking is not permitted inside any property, outdoor smoking areas are provided. Subletting, sharing or allowing people other than those contracted to stay at the property is prohibited.

If in the opinion of Kaluma Ski or in the opinion of any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other guests or any third party, or damage to property, or to cause a delay or diversion to transportation, Kaluma Ski reserves the right to terminate your booking immediately with no further liability to you. You and/or your party may also be required to pay for loss and/or damage caused by your actions and you and each member of your party will be jointly and individually liable for any damage or losses caused. Full payment for any such damage or losses must be paid directly to Kaluma Ski prior to departure.

Changes and cancellations by you

If you have to, or want to cancel or amend your booking, this request must be sent to us by  from the email address used to create the booking.

We will respond within two working days of receipt. Please ensure that you have received written confirmation of any changes to your booking prior to travel.

Whilst we will always try to help, we cannot guarantee that any specific requests will be met. Any amendments and cancellations can only be accepted in accordance with the Kaluma Ski booking conditions and cancellation charges may be payable. We strongly recommend that you take out a travel insurance policy which covers this eventuality.

Cancellations by Kaluma Ski

We will inform you as soon as reasonably possible if Kaluma Ski needs to make a significant change to your booking or to cancel it.

Kaluma Ski is entitled to cancel your booking at any time.

In the event that your holiday arrangements cannot proceed because your accommodation is not available for any reason and  Kaluma Ski is unable to provide a reasonable alternative, Kaluma Ski will refund the payments you have made to us for your booking. Should a reasonable or improved alternative be offered, a refund will not be applicable. Kaluma Ski will not be responsible for any other expenses including without limitation, the cost of flights or any other form of transport.

Except where otherwise expressly stated in these booking conditions, we regret neither we nor Kaluma Ski can accept liability or pay any compensation or expenses where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of “force majeure”. “force majeure” means any act or event beyond our reasonable control including but not limited to strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, or failure of public or private telecommunications networks. We strongly recommend that you take out a travel insurance policy which covers this eventuality.

Kaluma Ski may cancel your booking at any time with immediate effect if you do not arrive on the day in which your booking commences, or you have not notified us of a later arrival, Kaluma Ski will cancel the booking and you will not be entitled to a refund.

Injuries & loss of possessions

As your contract is with Kaluma Ski and we act as agent only, we accept no responsibility should you or a member of your party suffer injury or loss of possessions (through theft or accidentally) whilst staying with Kaluma Ski.

Complaints

Should you have a problem or complaint about the booking service that we provide, you must raise this at the time with us, via email life@watergatebay.co.uk.. This will enable most complaints to be handled in the shortest time possible. We are unable to respond to complaints about Kaluma Ski.

Should you have any queries or concerns about Kaluma Ski, and/or their services, this should be addressed to Kaluma Ski. If you have a problem during your stay at Kaluma Ski, this must be reported to [us / Kaluma Ski] immediately.

If you wish to complain when you return home, please contact Kaluma Ski, you will see their contact details in the confirmation we send you.

If you remain unsatisfied, you can inform us, via email life@watergatebay.co.ukas soon as possible and, in any event, within 28 days of the date of your stay at Kaluma Ski whereby we will endeavour to assist in our capacity as an agent by liaising with Kaluma Ski on your behalf.

Our liability to you

Our only contractual obligation to you is to take your booking in accordance with your instructions and provide you with a confirmation email in respect of your stay with Kaluma Ski. As agent, we accept no responsibility for your stay, or any other services provided by Kaluma Ski. Our responsibilities are limited to making the booking in accordance with your instructions.

We accept no responsibility for any information about Kaluma Ski that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment

Law and jurisdiction

These Agency Booking Conditions are governed by English law and are subject to the exclusive jurisdiction of the courts of Engalnd and Wales.
